Welcome to Range Game! These Terms of Service (“Terms”) govern your access to and use of the Range Game mobile application, website, and associated services (“Services”) provided by Range Game LLC (“Range Game,” “we,” “our,” or “us”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Acceptance of Terms

By using the Range Game app or accessing any of its features, you agree to these Terms of Service and our Privacy Policy. If you are under the age of 13 (or under 16 in certain jurisdictions), you must have parental or guardian consent to use the Services.

2. Description of Services

Range Game provides an interactive golf training platform, offering:

● Pre-Round Practice

● Range Game Practice (Sim Mode & Short-Range Mode)

● Etiquette & Rules

● Course Management

● Workout Plans (strength, mobility, neuromuscular, performance)

● Golf Drills

These services may be updated, added to, or removed at any time without notice.

3. Account Registration and Eligibility

To use many features of the Service, you must create an account. You must be at least 13 years old (or 16 in certain jurisdictions) or have verified parental consent. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials.

4. Health, Safety, and Waiver of Liability

Golf and exercise carry inherent risks. By using Range Game’s Workout Plan, Golf Drills, and other physical activities:

● You acknowledge and accept the risk of injury, property damage, or other harm.

● You affirm you are in sufficient physical condition to participate safely.

● Range Game is not responsible for any injury, accident, or property damage

resulting from your use of the Services.

● You waive and release Range Game LLC, its affiliates, partners, and contractors from any and all liability to the fullest extent permitted by law.

Always consult a medical professional before beginning any exercise program.

5. Acceptable Use

You agree not to:

● Use the Services for any unlawful, harmful, or fraudulent purposes.

● Upload or transmit viruses, malware, or other harmful code.

● Harass, threaten, impersonate, or defraud others.

● Violate the rights of others, including intellectual property or privacy rights.

● Use bots, scrapers, or similar automated means to access the Services.

We reserve the right to suspend or terminate your account for any misuse.

6. Business Accounts

Golf courses and other authorized businesses may register for Business Accounts to access analytics, host Range Game events, and engage users. By registering a business account, you represent that you are authorized to act on behalf of the organization. Range Game is not liable for misuse or misrepresentation by business users.

7. Merchandise & Transactions

Range Game may offer physical or digital merchandise through the app. All purchases are final unless otherwise stated. Range Game is not responsible for lost or damaged shipments. You agree to provide accurate payment and delivery information.

8. Advertising and Data Monetization

Range Game may:

● Display third-party or sponsored advertising.

● Provide advertisers with aggregated or anonymized user data.

● Use cookies and similar tracking technologies to deliver targeted ads.

9. Data Collection & Privacy

Your privacy is important. We collect and process your data in accordance with our Privacy Policy, which complies with:

All content on the Services, including graphics, logos, videos, workouts, and drills, is the property of Range Game LLC or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our permission.

11. Modification & Termination

Range Game may modify these Terms or the Services at any time. Continued use after updates constitutes acceptance. We may suspend or terminate your access for any reason, including violation of these Terms.

12. Dispute Resolution & Jurisdiction

These Terms and any dispute arising from your use of the Services shall be governed by the laws of the State of Texas, without regard to conflict of law principles.

● You agree to resolve any legal claims or disputes exclusively in the state or federal

courts located in Tarrant County, Texas.

● You waive any objections to such venue, including claims of forum non conveniens.

● If you are a resident of the European Union or other jurisdiction with mandatory local consumer laws, this section shall not override your statutory rights.

Range Game LLC is a Delaware-registered company with headquarters in Southlake, Texas, USA.

13. Indemnification

You agree to defend, indemnify, and hold harmless Range Game LLC, its directors, officers, employees, and partners from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

● Your use or misuse of the Services.

● Violation of these Terms.

● Violation of rights of any third party.

14. Limitation of Liability

To the fullest extent permitted by law:

● Range Game LLC shall not be liable for indirect, incidental, special, or consequential damages.

● Our liability for direct damages shall not exceed the amount paid by you for the Services in the preceding 12 months (if any).

15. Severability

If any provision of these Terms is found unenforceable, the remainder will remain in full force and effect.

16. Entire Agreement

These Terms, along with our Privacy Policy and Parental Consent (where applicable), constitute the entire agreement between you and Range Game regarding your use of the Services.
